American With Disabilities Act- A Good Step towards Right Direction!


The number of persons with numerous disabilities is mounting all over the world. The United States society is also not distant from this fact. The American with Disabilities Act is a Federal law that prohibits employers from discerning against a qualified person with disability.

Any person who is unable to continue doing his normal job that he was previously able to execute without any difficulty is termed as ‘disable’. Due to some mishap or accident, the person is no longer capable earning his livelihood to lead a peaceful and contended life.

It was on July 26, 1990, when President George Bush signed the law The Americans with Disabilities Act.  The law entitles disabled persons to enjoy and exercise rights of protection whether it is employment, entertainment, public services etc the persons are treated as ‘disabled’ and by virtue of this law they are entitled for equal opportunities.

The American with Disabilities Act makes necessary improvement for qualified disabled persons in the areas of employment, public accommodations, transportation, public services, and telecommunications. The Act of 1990 was enacted in response to the historical background of the 1970s and 1980s, struggle against disability.

The Rehabilitation Act of 1973 opened up several avenues for disabled persons including educational opportunities for all age groups. The Education for All Handicapped Children Act of 1974 (renamed the Individuals with Disabilities Education Act) was formulated to mainstream disabled students into customary classrooms, and also to make individualized educational programs for their enlistment.

After enacting these laws, there were adequate improvement in the fields of educational and vocational for the disabled, however, the employment opportunities in the private sector and access to the public utilities such as public and privately-operated transportation services, restaurants and other places of recreation, had not improved for disabled. Nevertheless, the Act is aimed to improve the condition of disabled persons with the American with Disability Act of 1990.
